Essential Business Support Fund and Returning California to Work Covid-19 Safety Protocol Fund Eligibility Requirements

All expenses must be:

  1. Applicant must be a current policyholder with State Fund and is eligible for reimbursement of COVID-19 related expenses as of March 1, 2020 or the inception date of the policy, whichever is later.
  2. Submitted by an authorized company representative.
  3. Associated with the COVID-19 pandemic.
  4. Direct costs only (i.e. equipment, shipping, handling, delivery, mileage and when approved, staffing).
  5. Related primarily to employee workplace safety.
  6. Not reimbursable or anticipated to be reimbursed to the policyholder by another entity or government program.
  7. Documented by written receipts, invoices or billing statements.  
  8. Related to new COVID-19 safety activities not previously in place or committed to by the policyholder prior to March 1, 2020.

EMPLOYER CERTIFICATION AND ASSURANCES

The undersigned represents, warrants, and certifies that:

  1. The signer is authorized to act on behalf of the listed State Fund policyholder.
  2. The signer has fully read and understands the requirements of the Essential Business Support Fund or the Returning California to Work COVID-19 Safety Protocol Fund program.
  3. All expenses to be incurred by the policyholder subject to this program, whether funded before or after qualifying purchases are made, meet all the Essential Business Support Fund or Returning California to Work COVID-19 Safety Protocol Fund program requirements.
  4. State Fund is not responsible for and assumes no liability for any goods purchased, and shall not be liable to the policyholder or the policyholder’s third-party agents, suppliers, or vendors engaged under or related to this program.
  5. The policyholder shall use funds provided under this program solely for costs, expenses, goods, or services expressly allowed, permitted, or authorized by Essential Business Support Fund or the Returning California to Work COVID-19 Safety Protocol Fund.
  6. At State Fund’s request, the policyholder shall remit itemized receipts, invoices, and all other documentation as may be reasonably required by State Fund evidencing use of any and all funds awarded by the Essential Business Support Fund or the Returning California to Work COVID-19 Safety Protocol Fund.
  7. The policyholder shall immediately remit to State Fund any funds which State Fund, in its reasonable yet sole discretion, deems to have been spent on goods, services, or activities not authorized under these programs.
  8. The policyholder shall immediately remit to State Fund any unused program funds upon the earlier of either the purchase deadline provided in any State Fund approval letter or the termination of the program.
  9. The policyholder understands that anything submitted to State Fund becomes a public record subject to California law.
  10. State Fund does not have and shall not acquire actual, constructive, virtual, or partial ownership of any goods, services, equipment, or improvements acquired by or engaged by the policyholder using funds awarded by the Essential Business Support Fund or the Returning California to Work COVID-19 Safety Protocol Fund.
  11. State Fund shall not have or incur any liability for the use of any good or services obtained through the Essential Business Support Fund or the Returning California to Work COVID-19 Safety Protocol Fund.
  12. No purchases or use of any program funds will directly benefit any State Fund employee.
  13. The policyholder expressly understands that the Essential Business Support Fund and the Returning California to Work COVID-19 Safety Protocol Fund are being provided to State Fund policyholders on a limited and gratuitous basis. State Fund reserves the right to discontinue or modify the Essential Business Support Fund and the Returning California to Work COVID-19 Safety Protocol Fund at any time, and at its sole and absolute discretion.
  14. The policyholder understands the Essential Business Support Fund and the Returning California to Work COVID-19 Safety Protocol Fund are not an offer to contract, and that the policyholder shall not acquire any contract rights, whether such rights are express, implied, direct, or indirect. The policyholder expressly waives any causes of action related to promissory estoppel.
  15. State Fund is not providing tax advice. All questions regarding tax impacts related to program participation must be directed to your tax professionals.
  16. The Returning California to Work COVID-19 Safety Protocol Fund is designated for policyholders in non-essential business sectors that have recently re-opened or are planning to resume operations. Grants in this fund will be awarded to policyholders with documented eligible expenses related to COVID-19 safety, and follow the State of California’s re-opening protocol of having:
    • A detailed risk assessment of their workplace
    • Employee training and implementation of a site-specific protection plan
    • Cleaning and disinfecting protocols and physical distancing guidelines
  17. Policyholders may apply for only one fund: those in essential business sectors may apply for the Essential Business Support Fund; those in non-essential business sectors may apply for the Returning California to Work COVID-19 Protocol Fund.

In addition, all California employers are required to have an Injury and Illness Prevention Program (IIPP, and a site-specific prevention plan.¬†Policyholders who do not already have these plans, can create them using State Fund’s IIPP Builder and model pandemic prevention plan.
